## Introduction

The Constitutional Convention was one of the biggest turning points in **Period 3 (1754–1800)**. The United States had won independence, but the first national government under the Articles of Confederation was too weak to solve major problems. By **1787**, many leaders concluded that the republic might fail unless the structure of government changed.

What makes this topic especially important for APUSH is that it combines **Politics and Power** with **American and National Identity**. The Convention forced delegates to answer basic questions: How strong should the national government be? How should states be represented? How could liberty be protected while still creating order? The proposed Constitution was the result of argument, bargaining, and compromise rather than simple agreement.

### Why the Convention met and why it went beyond revision

The Convention was called because the Articles of Confederation had serious weaknesses. Congress could not levy taxes directly, regulate interstate commerce effectively, or respond well to crises. The national government depended on the states for money and cooperation, which meant it often could not act at all.

A major warning sign was **Shays's Rebellion** in **1786–1787**. Armed farmers in Massachusetts, many of them veterans, protested debt, taxes, and foreclosures. The national government was powerless to stop the uprising. For many elites, this was not just a local disturbance. It suggested that weak government invited disorder and threatened property, credit, and the survival of the republic itself.

The **Annapolis Convention** in **1786**, promoted by **Alexander Hamilton**, drew few delegates, but it helped create momentum for a broader meeting in Philadelphia. Congress formally approved a convention to revise the Articles. Once delegates gathered, however, many quickly concluded that small repairs would not be enough.

This is a common exam distinction: the Convention was officially called to revise the Articles, but in practice it produced an entirely new system. That mattered because it showed how severe the crisis seemed to leading politicians.

The delegates themselves also shaped the outcome. There were **55 delegates**, all white men, many of them lawyers, merchants, or landowners. Their interests and assumptions mattered. Some historians have argued that the Constitution protected elite economic interests, while others stress broader concerns such as stability, union, and national survival. For APUSH, the safest position is that both motives mattered: the framers wanted stronger national government, and many also wanted a government that would protect property and social order.

### Representation crisis: Virginia Plan, New Jersey Plan, and Great Compromise

The first major conflict was over representation. This was not a side issue. It determined who would hold power in the new government.

The **Virginia Plan**, introduced by **Edmund Randolph** on **May 29, 1787** and shaped mainly by **James Madison**, proposed a strong national government with three branches. Most importantly, it called for representation based on population. Large states favored this because they would gain more influence in the legislature.

The Virginia Plan also proposed a **bicameral legislature**, a single executive, and a national judiciary. It was a direct break from the Articles because it created a government that could act directly on citizens rather than just on states. That is a major constitutional shift.

Small states feared domination by large states, so they backed the **New Jersey Plan**, introduced by **William Paterson** on **June 15, 1787**. This plan kept a **unicameral legislature** with equal representation for each state and revised rather than replaced the Articles.

The difference between the two plans was not just big states versus small states. It was also a disagreement over what the Union should be. The Virginia Plan assumed that the people, counted through population, should be the basis of national representation. The New Jersey Plan defended the states as political units that had entered a compact and should remain equal.

The solution was the **Great Compromise**, also called the **Connecticut Compromise**, adopted on **July 16, 1787**. It created a bicameral Congress:

- **House of Representatives**: representation based on population
- **Senate**: equal representation, with **2 senators per state**

This compromise worked because it gave each side something vital. Large states gained influence in the House. Small states protected their equality in the Senate. Without it, the Convention might have collapsed.

Students often miss the logic here. The Great Compromise did not end disagreement by proving one side right. It preserved the Union by splitting power between two principles of representation: **population** and **state equality**.

### Slavery and commerce compromises

The Convention also had to confront slavery, though delegates often used indirect language. These debates show that compromise made the Constitution possible, but also embedded slavery into the national system.

The **Three-Fifths Compromise**, agreed to on **July 12, 1787**, determined that for purposes of **representation and direct taxation**, enslaved people would be counted as **three-fifths** of a person.

This increased southern power in the House and, because presidential electors were based on congressional representation, also increased southern influence in the **Electoral College**. That point is crucial. The compromise did not just affect Congress. It affected presidential politics too.

Just as important is what the compromise did **not** do. It did not give enslaved people voting rights or citizenship. Southern states gained political power from people they kept enslaved and denied basic rights.

Another major deal was the **Commerce and Slave Trade Compromise**. Northern delegates wanted Congress to regulate interstate and foreign commerce. Southern delegates, especially from **South Carolina** and **Georgia**, feared this power might be used against slavery and export agriculture.

The final arrangement did three important things:

- Congress could regulate **interstate and foreign commerce**
- Congress could not tax **exports**
- Congress could not ban the **international slave trade before 1808**

The Constitution also included a **Fugitive Slave Clause**, requiring the return of escaped enslaved people.

These compromises reveal a cause-and-effect chain APUSH students should know well:

1. Southern states feared a strong national government might threaten slavery
2. Delegates made concessions to keep those states in the Union
3. The Constitution became ratifiable partly because slavery was protected

That is why historians often describe the Constitution as both a framework for republican government and a document shaped by sectional bargaining.

### The proposed Constitution: structure and major change from the Articles

Once representation and slavery questions were managed, delegates built the broader structure of the new government. The proposed Constitution established **three branches**:

- **Legislative**
- **Executive**
- **Judicial**

Each branch had powers to limit the others.

The executive branch was also stronger than anything under the Articles. The Convention created a **single president** with a **four-year term**, eligible for reelection. Delegates rejected both a weak executive and anything too close to monarchy. The result was a president strong enough to enforce laws, lead the military, and conduct foreign policy, but still checked by Congress.

The method of election was another compromise: the **Electoral College**.

This balanced competing fears. Some delegates distrusted direct popular election. Others did not want Congress to control presidential selection. The Electoral College stood between pure democracy and legislative appointment.

Under **Article VII**, the Constitution would take effect when **9 of 13 states** ratified it through **state conventions**, not state legislatures.

That choice mattered. Ratification by conventions let supporters claim authority from "the people" rather than from existing state governments, which might resist losing power.

The proposed Constitution was a major departure from the Articles in several ways:

- it could tax
- it could regulate commerce
- it created an executive
- it created a national judiciary
- it could act directly on individuals
- it no longer required unanimity for basic change

This is the core APUSH takeaway: the Constitution shifted the United States from a loose confederation toward a stronger **federal** republic.

### Why these compromises mattered in later ratification debates

Even though this article focuses on the Convention and proposed Constitution, you should connect these compromises to later debates over ratification. The very features that made agreement possible also created opposition.

Federalists argued that the Constitution solved the failures of the Articles while protecting liberty through structure. They defended a stronger union, a larger republic, and checks and balances. Their ideas were famously developed in the **Federalist Papers**, especially **Federalist No. 10** and **Federalist No. 51**.

Anti-Federalists argued that the national government would become too powerful, the president might become king-like, and the absence of a **Bill of Rights** threatened liberty. Key critics included **Patrick Henry**, **George Mason**, and **Richard Henry Lee**.

The Convention compromises therefore had a double effect:

- they made a finished Constitution possible
- they also created fears and objections that had to be answered during ratification

The promise to add a **Bill of Rights** later helped secure approval in closely divided states such as **Massachusetts**, **Virginia**, and **New York**.
